Planning and Zoning Commission 07 Aug 06 meeting - minutes
SUMMARY: The P&Z Commission stipulated that the developer’s proposed preliminary plat for the new Canyon Villas subdivision be approved for 18 months subject to:
CONDITION 20: “Resolving the location for an extension of a 20-foot wide trail easement to the east property boundary of Tract B-2 (to reach Chugach State Park to provide access to the North Fork of Campbell Creek) with Watershed Management and Engineering, the Municipal Trails Coordinator, and Chugach State Park staff, to seek to minimize the impact of a trail extension on the wetlands, streams, the potential for erosion, any adverse impact on the headwaters of Campbell Creek and maximize the usability of the trail given the steep slopes. The trail easement shall be GPS’d and the easement shown on the final plat.”
and
CONDITION 22: “Resolve with Project Management and Engineering the appropriate location for a sufficiently wide roadbed development to allow parking for approximately six cars with access to the trailhead.”
NOTE: In page 19 of the minutes, COMMISSIONER COTTEN asked if a private road allows owners to restrict access. MR. LESH (MOA staff member) replied that it is possible to restrict vehicular access; however, pedestrian access is allowed across the property.
Mr. Lesh was called about his remarks. He said did NOT mean that pedestrians could use the private road. He meant to say (or intended to say or perhaps he did say but was not recorded as saying) that pedestrian access would be allowed across the property on the proposed pedestrian easement.
His reply is ambiguous and misleading but moot for CSP access through Canyon Villas Estates subdivision since the PZC stipulated a pedestrian easement to CSP starting at a street ROW.
